Perrigo has confirmed filing for generic version of Gynazole-1® Cream and announced a Patent Infringement Lawsuit by KV Pharma
Recently, Perrigo Company filed an abbreviated new drug application (ANDA) for butoconazole nitrate vaginal cream 2% at U.S. Food and Drug Administration.
According to the company, they notified the owner of the new drug application (NDA) which is the KV Pharmaceutical Company and Femme Pharma the listed owner of the patent and ANDA filing.

However on July 29, 2010, KV Pharmaceutical Company, the licensee under the patent filed a suit at U.S. District Court of Delaware for alleging patent infringement to stop Perrigo Company from commercializing the product.
Gynazole•1® (butoconazole nitrate) vaginal cream, 2% (to treat local vulvovaginal candidiasis cased by candida) have an estimated annual income of $28 million measured by Wolters Kluwer Health before the manufacturing stopped in January 2009 due to KV’s manufacturing issues.
Today, Perrigo Company do their best to obtain the rights for product filing to put the effective product into the market once again.
